Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Brookside Storage website and Brookside Storage’s text messaging program. By using the website, you agree to these Terms. Your rental is also governed by your separate rental agreement. If these Terms conflict with the rental agreement on a rental-related issue, the rental agreement controls.

Website use

You may use this website only for lawful purposes. You agree not to interfere with the website’s operation or security, attempt unauthorized access, introduce malicious code, scrape the website in a manner that disrupts it, impersonate another person, or use the website to violate another person’s rights.

Rental information and availability

Unit and parking-space sizes are approximate. Prices, promotions, features, and availability may change and are subject to confirmation. Website content is provided for general information and does not replace the terms of a signed rental agreement. You are responsible for providing accurate, current information when you inquire, rent, pay, or communicate with us.

Payments and third-party services

Payments and some website or account features may be provided by third-party service providers. Your use of those services may be subject to additional terms and privacy policies. Fees, payment deadlines, late charges, lien procedures, insurance or protection-plan terms, and other rental obligations are governed by your rental agreement and applicable law.

Brookside Storage SMS program

By actively selecting the optional SMS consent checkbox during the rental process, you request enrollment in recurring automated transactional text messages from Brookside Storage at the mobile number you provide. Messages may include welcome and move-in information, unit and gate-access details, lock information, payment reminders or links, and account or facility service updates.

Consent: Consent to receive text messages is not a condition of renting or purchasing. The SMS checkbox must be optional and unchecked by default.
Frequency: Message frequency varies, up to 4 messages per month.
Charges: Message and data rates may apply. Your mobile carrier’s terms and charges govern.
Opt out: Reply STOP to any Brookside Storage message to opt out. After you opt out, you may receive one confirmation message, and then no further program messages will be sent unless you enroll again.
Help: Reply HELP for help, call (586) 800-2091, or email tim@brooksidestorage.com.
Supported carriers: Wireless carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and is not guaranteed.
Your number: You represent that you are the subscriber or customary user of the mobile number provided and are authorized to consent to messages at that number. If your number changes or is reassigned, you agree to opt out or notify us promptly.

Intellectual property

The website and its text, graphics, logos, images, design, and other content are owned by Brookside Storage or its licensors and are protected by applicable intellectual-property laws. You may use the website for your personal, noncommercial interaction with Brookside Storage, but may not reproduce or distribute its content without permission except as allowed by law.

Disclaimer

To the extent permitted by law, the website is provided “as is” and “as available.” We do not warrant that it will always be uninterrupted, error-free, or free of harmful components. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

Limitation of liability

To the extent permitted by law, Brookside Storage will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the website or SMS program. This limitation does not apply where prohibited by law and does not alter liability or remedies established in a separate rental agreement.

Changes and termination

We may update these Terms or modify or discontinue website or messaging features. Updated Terms will be posted on this page with a revised effective date. You may end SMS participation at any time by replying STOP. We may suspend access or messaging when reasonably necessary for security, legal compliance, misuse prevention, or program operation.

Governing law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any mandatory rights or venue requirements under applicable law remain unaffected.
